Agreement to terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Frags & Flavs (“we,” “us” or “our”), concerning your access to and use of the www.fragsnflavs.com website as well as any other media form, media channel, mobile website related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site solely for personal, non-commercial use. We reserve all rights not expressly granted to you.

User representations

By using the Site, you represent and warrant that:

• (2) you will maintain the accuracy of such information and promptly update such registration information as necessary;

• Use the Site to compete directly with Frags & Flavs.

Any violation may result in termination of access.

User-generated contributions

The Site may allow you to submit reviews, messages for heartfelt cards, feedback, or other content (“Contributions”).

When you create or submit Contributions, you represent and warrant that:

• Your content does not infringe third-party rights.
• Your content is not defamatory, abusive, illegal, or offensive.
• Your content does not promote hate, violence, or unlawful activity.
• Your content does not contain malicious code.

We reserve the right to remove Contributions at our discretion.

Contribution license

By posting Contributions, you grant Frags & Flavs a non-exclusive, worldwide, royalty-free license to use, display, and distribute such Contributions for operational and promotional purposes.

You retain ownership of your Contributions.

Guidelines for reviews

When posting a review:

• You must have purchased the product.
• Reviews must not contain abusive, hateful, or discriminatory content.
• False or misleading statements are prohibited.
• Competitors may not post malicious reviews.

We reserve the right to remove reviews.

Third-party websites and content

The Site may include links to third-party services such as Razorpay or logistics partners. We are not responsible for third-party policies or practices.

Site management

We reserve the right to:

• Monitor for violations
• Restrict or disable access
• Remove content
• Protect our brand and systems

Term and termination

We may terminate or suspend your access to the Site without notice if you violate these Terms.

Modifications and interruptions

Dispute resolution

The Parties agree to attempt to resolve disputes informally for at least 30 days before pursuing legal action.

Binding Mediation

If unresolved, disputes shall be resolved through mediation in India.

Corrections

We reserve the right to correct errors, pricing inaccuracies, or product descriptions at any time.

Disclaimer

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

Limitations of liability

We may store certain data transmitted to the Site. You are responsible for your own data. We are not liable for data loss.

Electronic communications

You consent to receive electronic communications and agree that electronic agreements satisfy legal requirements.

Miscellaneous

These Terms constitute the entire agreement between you and Frags & Flavs.

We may assign rights at any time.

If any provision is unenforceable, the remaining provisions remain valid.

No joint venture or partnership is created.
